Terms of Use

1. Eligibility and accounts

You must be at least 13 years old and legally able to agree to these Terms. If you are under the age of legal majority where you live, a parent or guardian must review and accept these Terms. You are responsible for activity associated with your device and account and for keeping your information accurate.

2. Exercise and safety

WarmUp Runner is a fitness game, not medical advice, diagnosis, treatment, or an emergency service. Exercise involves risk. Consult a qualified healthcare professional before beginning if you have a medical condition, are pregnant, have been advised to limit activity, or are unsure whether exercise is appropriate for you. Use a clear, stable, well-lit space; keep away from traffic, stairs, obstacles, and fragile objects; wear suitable footwear; and stop immediately if you feel pain, dizziness, faintness, unusual shortness of breath, or illness. Call local emergency services when needed.

3. Results and integrations

Distance, pace, calories, pose tracking, scores, achievements, and other results are estimates for entertainment and general fitness use and may be inaccurate. Do not rely on them for medical or safety decisions. Apple Health, Health Connect, Strava, and other third-party services are optional and governed by their own terms. You are responsible for reviewing data before sharing it.

4. License and acceptable use

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services. You may not:

• copy, sell, sublicense, reverse engineer, tamper with, or create derivative works from the Services except where law permits;
• cheat, manipulate results or leaderboards, bypass access controls or purchases, interfere with operation, or use automated abuse;
• upload unlawful, harmful, infringing, deceptive, or privacy-violating names, images, or content; or
• use the Services in a way that endangers you or another person.

5. Subscriptions and purchases

• The price, billing period, trial (if any), and included features are shown before purchase and confirmed by Apple.
• Auto-renewable subscriptions renew unless canceled at least 24 hours before the end of the current period. Apple charges your account and manages billing, cancellation, and refunds under its rules.
• You can manage or cancel in iPhone Settings under your Apple account subscriptions. Deleting the app or requesting data deletion does not cancel a subscription.
• Use Restore Purchases in the app to restore eligible purchases. Features and prices may change prospectively; changes do not override Apple notices or applicable consumer rights.

6. Your content and public profile

You retain rights in content you submit, such as a profile image. You give us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display that content only as needed to operate and improve the Services. You represent that you have the necessary rights. We may remove content or restrict public features that violate these Terms.

7. Ownership and feedback

The Services, software, art, trademarks, and other materials are owned by DuckProject or its licensors. If you send feedback, you allow us to use it without restriction or compensation, without identifying you publicly unless you agree.

8. Availability, suspension, and termination

We may maintain, change, suspend, or discontinue parts of the Services. We may suspend or terminate access when reasonably necessary for security, legal compliance, abuse prevention, or a material violation of these Terms. You may stop using the Services at any time and request deletion through Privacy Choices.

9. Disclaimers and liability

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, DuckProject will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, or loss of profits arising from the Services. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

10. Apple terms

For an app downloaded from Apple's App Store, Apple is not responsible for the Services or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple's Standard Licensed Application End User License Agreement also applies; if these Terms conflict with mandatory Apple terms, those Apple terms control for App Store use.

11. Changes and contact

We may update these Terms and will post the new effective date. Continued use after an update means you accept the revised Terms where permitted by law. For questions, contact support@duckproject.app.
